Community Association Law

Condominium and homeowners associations must deal with, and operate under, many complex documents and required procedures such as covenants, governing documents, amendments, membership votes, assessments, liens, and foreclosures. We handle the complete spectrum of legal issues for community associations. As a part of our ongoing representation of our clients we also manage all real estate issues such as disputes arising from purchase agreements and construction contracts, and title disputes.

Legal Services for Community Associations:

We specialize in helping directors and managers of  condominium,  homeowner, and property owners’ associations in all of their legal issues.  Community association law presents a unique set of legal challenges, with issues involving real estate law, corporate law, financing, environmental law, insurance and commercial litigation.

Living in a Community Association

Nearly one out of every six Americans lives in a community association; in some large metropolitan areas more than half of new home sales are within community associations. These associations are governed by a Board of Directors comprised of residents from the community, who come from varied backgrounds but share a common desire to provide an enjoyable lifestyle and stable community for their families and neighbors.

Legal Challenges of Community Associations

Community associations typically provide services, regulate activities, impose design standards and levy assessments upon property owners. They collect dues from members to cover the community’s common expenses, such as recreational amenities or water or trash service, and may impose special assessments for major improvements to the property.  We specialize in helping homeowners’ and condominium associations boost their bottom line and improve quality of life for the residents they serve, by handling everything from negotiating contracts to preserving property values by enforcing covenants.

Our Experience

We have handled scores of issues for community associations such as interpreting and enforcing covenants and legal documents, advising Boards of Directors about their legal rights and obligations under the governing documents, drafting and revising governing documents, coordinating meetings and votes for amendments, collecting assessments, and perfecting liens.  We also have significant experience litigating community association issues such covenant disputes and enforcement, disputes arising from contracts with vendors.
